WHAT DATA IS USED & WHY

WHAT DATA WE PROCESS

In general, we only process your data when it is necessary for our legitimate business purposes, when required to be required by applicable law, or when you provide us with your data voluntarily (i.e. by providing your consent).

We will not knowingly collect online data about children through our websites and apps, and in other situations, we only collect such data when it this is provided by relevant laws or where you give us your express and informed consent, and we always involve the parents or guardians of the affected children.

We always need a reason ("purpose") and a legal basis, both as permitted by law, to process your personal data. Any data used by the app and website will either be stored on your device, outside of our control, or used by Google Analytics, as described below.

DATA PROCESSED BY US WHEN YOU USE OUR WEBSITE

PURPOSE: To fulfill contract with you (e.g. when you order our products, sign a business contract, deliver products or services to us, or receive products or services such as seminars or training events from us).

LEGAL BASIS: Performance of the contract (GDPR Article 6 (1)(b)).

RETENTION PERIOD: For the duration of the contract and two years thereafter (may be extended if legally required)

REQUIREMENT: Mandatory for contract execution; without it, we cannot deliver or receive products/services.

PURPOSE: To efficient and secure business operation, product/service quality assurance

REQUIREMENT: Providing this data is not legally required, but it may be necessary to maintain our business relationship. You can choose not to provide certain information, though this may limit our ability to offer some services.

WHO WILL WE DISCLOSE YOUR PERSONAL DATA TO (RECIPIENTS OF PERSONAL DATA)

i. ALK GROUP & EXTERNAL PROCESSORS

The recipients of your personal data will be entities belonging to ALK Group and external processors providing specific services and processing personal data on our behalf and only in accordance with our instructions. They will receive your personal data only on a need-to-know basis, being subject to the obligation of confidentiality and after signing appropriate legal documents. Where we transfer personal data outside of the European Economic Area (or outside the UK, if that is where you are based), we ensure a similar degree of protection is afforded to it by putting in place appropriate safeguards.

ii. INDEPENDENT THIRD PARTIES

We may disclose your personal data to third parties (such as attorneys) when this would be necessary for the establishment, exercise or defence of legal claims or to public authorities, when required by the law, or, when needed, to independent third-party auditors.

iii. TRANSFER OF DATA FROM EU/EEA TO THIRD COUNTRIES

If we provide access or disclose your data to a company or an ALK affiliate in a third country outside the EU/EEA, we will apply contractual clauses that match EU standards or use other appropriate safeguards (e.g. ensure that the recipient is certified under to the EU-US Data Privacy Framework) to ensure that the receiving company handles personal data appropriately unless the country where the company operates is already deemed by the EU to offer an adequate level of data protection. . GOOGLE ANALYTICS

To tailor our website to meet your needs, we create pseudonymous user profiles with the help of Google Analytics. Google Analytics uses "cookies", i.e. text files stored on your computer, which enable an analysis of your website use. The information generated by the cookie about your use of the website is usually transferred to a Google server in the USA and stored there. However, since we have activated IP anonymization on this website, your IP address will be shortened by Google beforehand within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Google will use this information to evaluate your use of the website for us, to compile reports on website activity and to provide us with other services related to website activity and internet usage. You can object to the creation of pseudonymous user profiles at any time. There are several options for doing so:

One way to opt out of web analytics by Google Analytics is to set an opt-out cookie, which instructs Google not to store or use your data for web analytics purposes. Please note that with this solution, web analytics will only be denied as long as the opt-out cookie is stored by your browser.

GOOGLE ANALYTICS DEMOGRAPHIC AND INTEREST REPORTS

This website uses Google Analytics Demographic and Interest Reporting. Through these reports, we receive statistical data from Google on, among other things, the age, gender, language, and interests of our website visitors. This data cannot be traced back to a specific individual. You can deactivate Google Analytics Demographic and Interest Reporting at any time via Google's ad settings, or alternatively, use the options described above to completely opt out of the creation of pseudonymous user profiles by Google Analytics.

i. ACCESS AND RECTIFICATION

You may access your data, as well as have inaccurate data rectified.

You are entitled to obtain a copy of your data, which will be provided to you in such a way as to respect the rights and privacy of other persons.

You are also entitled to ask us to provide you with any relevant details concerning the processing of your personal data.

ii. DATA PORTABILITY

You are entitled to receive data you have provided to us in a portable format (structured, commonly used and machine-readable format) and to have such data transferred to you or, when feasible, directly to another entity or person you expressly choose.

Please note, that the data will be provided to you in such a way as to respect the rights and privacy of other persons.

iii. RIGHT TO OBJECT

You may object to the processing of your personal data which is processed based on our legitimate interests and there is something particular about your situation which makes you want to object to processing on the grounds that you believe it impacts on your fundamental rights and freedoms.

You also have the right to object at any time when such data is processed for direct marketing purposes without giving any reasons.

iv. RIGHT TO WITHDRAW CONSENT

Your withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

v. ERASURE ('RIGHT TO BE FORGOTTEN')

You may ask for your personal data to be deleted and no longer processed at any time. However, we may not always be able to comply with your request for erasure for specific legal reasons (e.g. if some data still needs to be stored for tax reasons) in which case, we will notify you of these reasons and give you an indication of when that data is likely to be deleted. Note that the right to erasure does not apply to anonymous statistical data (which will not contain any personal data) used for statistical, marketing and research purposes.

vi. RESTRICTION OF PROCESSING

Instead of erasure, you may ask to have your data restricted. Further processing of restricted data may take place only with your consent or for reasons expressly stipulated by applicable law(s). If the restriction would not be possible, because of justified legal reasons, you will be expressly informed about such reasons before the restriction is lifted.

RETENTION PERIOD

We may for specific purposes ask for your consent to collect and process your personal data. Where our processing is solely based on your specific consent you have the right to with-draw your consent at any time by contacting us for this purpose at data.protection@alk.net. Such withdrawal will not affect the lawfulness of processing based on consent before its withdrawal.
